What Are The Consequences Of A Criminal Conviction In New Jersey?

New Jersey’s criminal justice system categorizes offenses into two categories: disorderly persons offenses and indictable crimes. Disorderly person offenses are similar to misdemeanors in other states and include less serious crimes, such as petty theft, disorderly conduct, shoplifting and possession of drug-related items. While these offenses are considered less severe, they can still result in up to one year in jail and $1,000 in fines, potentially impacting your life significantly.

Indictable crimes, however, are more serious offenses. These include crimes like murder, kidnapping, rape, other sex crimes, manslaughter, robbery, arson and aggravated assault.

To reflect the varying degrees of severity, indictable crimes are further divided into classes. Each class carries different sentences based on the degree of the offense:

  • First-degree: The most serious; these can result in 10 to 20 years in prison and fines amounting to $250,000.
  • Second-degree: These may lead to five to 10 years in prison and fines up to $150,000.
  • Third-degree: Penalties include three to five years in prison and fines of up to $15,000.
  • Fourth-degree: The least severe, but still serious; these can result in up to 18 months in jail and $10,000 in fines.

In criminal cases, prosecutors bear the burden of proof. This means they are responsible for providing compelling evidence that demonstrates a defendant’s guilt beyond any reasonable doubt. This is a fundamental part of due process, which protects your rights throughout the legal proceedings. However, the potential consequences of a conviction make it crucial to have a skilled criminal defense attorney by your side.
